William Kirk, the President of Washington Gun Law, raised significant concerns over the ATF’s handling of the Bryan Malinowski case. Speaking on Washington Gun Law (WGL) Youtube channel Kirk dissected the fatal ATF raid at Malinowski’s home in Arkansas.
Kirk opened his talk by questioning the ATF’s approach. Specifically, the WGL aptly framed it this way, “The manner in which the ATF chose to execute the warrant, and in turn execute Mr. Malinowski, leaves all of us wondering – is this proof that the ATF will sometimes, just kill you?”
Kirk described Malinowski’s involvement in selling firearms without background checks as “questionable activity” that likely provided probable cause for arrest. However, Kirk stressed the significance of how the ATF conducted the raid.
“This is an organization which has really been let off the leash the last few years,” Kirk commented, pointing out the troubling implications of such unchecked power.
They did have good probable cause that the man was dealing without a license. That said , There was no evidence at all that he was violent and this search warrant did not have to be done at 6 in the morning with a SWAT team. Hell a team in suits or other appropriate dress could have served this warrant with no bloodshed.
